An Airbnb owner’s attempt to claim part of a beach as a private garden has been struck down by the local authority.

The owner of Sea Willow, a luxury rental in Middleton, Sussex, had fenced off a section of Elmer Beach, advertising it as a “private beach area” for guests. A two-night stay in peak season costs around £2,500.

Despite arguing that the land was historically part of the property’s garden, Arun District Council ruled that it was not previously within the home’s curtilage and found the fence intrusive.



Residents and local groups strongly opposed the move, citing concerns over public access, environmental impact, and the risk of setting a dangerous precedent. Objections came from the Elmer Beach Residents Association, Middleton Parish Council, and 19 nearby homeowners.

Officials rejected the retrospective planning application, ensuring the beach remains open to the public.
