Revised code of conduct for property factors to come into force in August

Legislation to ensure property factors adhere to a consistent standard was laid before the Scottish Parliament yesterday.

Property factors are responsible for managing common parts of land or properties, overseeing maintenance and repair work on behalf of homeowners. Those included on the Property Factor Register are required to ensure compliance with the Code, which was originally published in October 2012.

A full public consultation was undertaken between October 2017 to January 2018, with the findings feeding into this revised version.



The revised Code of Conduct for Property Factors sets out minimum standards of practice and encourages transparency, while ensuring that homeowners know what to expect from their property factors.

Housing minister Kevin Stewart said: “Property factors play an important role in supporting people to ensure common property is protected and maintained.

“This revised Code of Conduct has been brought up to date, clarified and strengthened, ensuring that all registered property factors operate consistently and to the appropriate standards, while also giving homeowners confidence in what their factor is offering them.”

The original Code was published in October 2012. A full public consultation was undertaken between October 2017 to January 2018, with the findings feeding into this revised version.



Subject to approval from the Scottish Parliament, the revised Code will come into force on 16 August 2021.
