Shona has specialised since 1994 in construction dispute resolution. Dual accreditation by Law Society of Scotland as specialist in Construction Law and in Arbitration Law. Fellow of Chartered Institute of Arbitrators.

Experienced in all forms of construction dispute resolution acting for parties and as legal adviser to arbitrators and adjudicators. Familiar and works regularly with both standard form (including JCT, SBCC, NEC, ICE, IChemE) and bespoke contracts. Worked extensively with PFI/PPP contracts, particularly water/sewage treatment, schools and hospitals.

Shona is a Member of Scottish Building Contract Drafting Committee (responsible for SBCC standard form building contracts) since 2004. She is the SBCC representative on JCT BIM Working Group. Member of Law Society of Scotland Construction Law Committee.

CEDR Accredited Mediator and CEDR Neutral. Participated as a Mediator in a Mediation Pilot scheme for Sheriff Court disputes and acts as Arbitrator for ABTA Arbitrations.

Shona will be presenting the Legal Perspective on BIM at the BIM Convention on Thursday 22 October 2015 at the Glasgow City Hotel, Cambridge Street, Glasgow, which is being attended by industry leaders representing all sections of the Scottish Construction industry.

Shona’s presentation will cover the current position in relation to contractual provision for BIM in standard form construction contracts and appointments and the need for interaction of these with BIM Protocols. She will also consider the new roles inherent in BIM contracts namely that of Information Manager/BIM Co-ordinator.

The question arises of whether what is in place currently is sufficient and, if not, what is missing from current contractual arrangements? The approach of insurers is a key aspect to BIM and I will look at the current position in the UK market in relation to their approach. Finally, BIM and soft landings are topics which are very much linked and some consideration will be given to the position in relation to soft landings.
